By accessing or using rcamap.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is provided by Abhin Chhabra, a sole proprietor operating in Canada.

2. Eligibility

You must be at least 13 years old to use the Service. By using rcamap.com, you represent and warrant that you are at least 13 years of age.

The Service is not intended for children under 13. The product is designed and marketed for business users, including teams and working professionals.

3. Account Registration

To access certain features of the Service, you must create an account using your email and password via Clerk authentication services.

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

4. Service Description

rcamap.com provides:

Root cause analysis tools with AI guidance
Storage and sharing of incident data
Support for team collaboration
Visual investigation mapping using the "5 Whys" methodology

Beta Status: The Service is currently in beta/experimental phase. Features, functionality, and service reliability may change rapidly with little notice. Interruptions, bugs, and unexpected behavior are possible during this phase.

5. Paid Features and Subscriptions

Free Tier

A free tier is available with limited features and AI usage.

Paid Plans

Paid subscription plans are available via Stripe and unlock:

Additional AI usage credits
Advanced features
Higher usage limits

Billing Terms

Subscriptions automatically renew monthly unless cancelled
Additional AI credits may be purchased à la carte
No refunds are provided for any reason, including partial billing periods
You may cancel your subscription at any time; access to paid features continues until the end of your current billing period

Taxes

Prices displayed may not include sales tax, VAT, or GST. Applicable taxes will be calculated and added during checkout based on your jurisdiction. Abhin Chhabra is responsible for collecting and remitting taxes where required by law.

6. AI Features and Limitations

AI Credit System

Users may use AI copilot features until their credits are exhausted
When credits run out, AI features are disabled
Manual features remain accessible without AI assistance
Additional credits may be purchased as needed

AI Output Disclaimer

AI-generated output may be inaccurate, incomplete, or unsuitable for your specific context. You must independently verify all AI-generated results, including summaries, suggestions, and analysis. Use of AI features is at your own risk.

7. User Content and Data Rights

Your Content

You may provide work details, confidential company data, and other information into RCA sessions ("User Content").

Responsibility

You must not upload or share data that:

You do not have authority to share
Violates any law or regulation
Infringes on intellectual property rights of others
Contains confidential information belonging to others without authorization

License to Us

By submitting User Content, you grant Abhin Chhabra a non-exclusive, worldwide, royalty-free license to:

Process your content to provide the Service
Perform analytics and improve the Service
Improve AI models and features

Ownership

You retain ownership of your User Content. This license does not transfer ownership rights.

8. Acceptable Use Policy

You agree not to:

Upload illegal, harassing, abusive, or harmful content
Attempt to gain unauthorized access to other accounts or data
Upload or share data you do not have the right to share
Attempt to disrupt, damage, or reverse engineer the Service
Use the Service in any way that violates applicable law or regulation
Engage in any activity that interferes with or disrupts the Service

Violation of this policy may result in immediate suspension or termination of your account.

9. Data Sovereignty and International Transfers

User data is stored in the United States on AWS servers (us-east-1 region via Supabase).

By using the Service, you:

Consent to the storage and processing of your data in the United States
Acknowledge that your data may be subject to U.S. laws and regulations
Understand that data may be transferred across international borders

10. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
UNINTERRUPTED OR ERROR-FREE OPERATION
ACCURACY OR RELIABILITY OF RESULTS

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ABHIN CHHABRA SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS
LOSS OF DATA
LOSS OF BUSINESS OPPORTUNITIES
COST OF SUBSTITUTE GOODS OR SERVICES
DAMAGES ARISING FROM USE OF THE SERVICE OR AI OUTPUT

THIS LIMITATION APPLIES EVEN IF ABHIN CHHABRA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF THE SERVICE AND ANY DECISIONS MADE BASED ON AI OUTPUT OR OTHER SERVICE FEATURES.

12. Beta Warning

rcamap.com is currently in beta/experimental phase. This means:

Features may change without notice
Service reliability and availability may vary
Data loss is possible (though we take reasonable precautions)
The Service may be discontinued at any time
Pricing and terms may change as the Service evolves

13. Termination

By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

Breach of these Terms
Abuse of the Service
Non-payment of fees
Any other reason at our sole discretion

By You

You may cancel your account at any time through the Service settings or by contacting legal@abhin.atlassian.net.

Effect of Termination

Upon termination:

Your access to the Service will be immediately revoked
Your data will be retained for 30 days and then deleted
No refunds will be provided for any remaining subscription period

14. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles.

Dispute Resolution

All disputes arising from these Terms or the Service shall be subject to binding arbitration under Canadian law.

Jurisdiction

If arbitration is contested or unavailable, the courts of Canada shall have exclusive jurisdiction over any disputes.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

The "Last Updated" date will be revised
Continued use of the Service constitutes acceptance of the modified Terms
Material changes may be announced via email or Service notification
